Legal Question in Business Law in Texas

Is a service mark right for me?

I was wondering if I registered for a service mark if I still needed to register my DBA in every county that I wanted to do business in. Also, if I get a service mark should I still get incorporated and why? If I get incorporated do I need to be established in each county or I am covered for the entire state?

Re: Is a service mark right for me?

You still need to file a dba in each county where you are doing business. Registering the service mark protects your interest in the mark itself, and keeps others from poaching on your goodwill.

There are numerous reasons for incorporating. Not having to register in each county is just one of them, unless the corporation is doing business under a different name;i.e. ABC, Inc. d/b/a XYZ.
