Legal Question in Business Law in Texas
SOB laws
Ok...I live in a area that does not allow alcohol sales. So a place opens that charges slightly more for food, but then gives beer away and it's legal. So...that being said. Why can't someone buy a building, life in that building (so it's their residence)and have strippers come in and dance, and with something like a ''donation'' of $30 give beer away. Basically open up a strip club? Since it would be your residence, and technically under the law not a business. Is this legal?

Well here are a couple of problems with your theory:
1. the "donation" is not a donation if you expect it and insist on it. In other words what if a guy shows up and wants in for free. If you charge, now not a donation but you are selling admission and thus a business.
2. If the "girls" charge and collect tips.. then that is an SOB right thre. So you have to convince the girls to dance for free.
In short, you couldn't charge to get and the girls have to work for free.

I was going to answer you but Mr. Pfister's response says it all. They only way for you to find a loophole is it have an attorney find it, and it will last for as long as it takes for your municipality to change the laws.
