Legal Question in Business Law in Texas
Starting a non-profit 501(c)3 corporation
I have put the cart in front of the horse by obtaining an EIN from the IRS prior to filing a non-profit corporation compliance ''letter of formation'' with the state(article of incorporation). Will i be permitted to file the letter of formation using the same name as is identified by the existing registered EIN? Also, have I broken any laws if donations from the general public have already been received. If so, how can I recocile this situation.

Certainly you can incorporate a non profit using the same name as is on the SS-4 (EIN APP). As to the donations, if you have represented to the people making donations that these payments are tax deductible, you have a problem
