Being Sue

We are being sue by a customer that claims we damage the film on the window.

They paid but put a stop payment the day we finished.

We are being served. What should we do?

How do we reply? thanks

You have to file a written answer with the court stating that you deny the allegations. You should send a copy to the other side as a courtesy (and as a matter of complying with the Rules of Civil Procedure.

If they gave you the check to claim completion of the work, or to recover a vehicle if the film was window tinting, you should go to the nearest JP and see if they'll take a 'hot check' charge.

As to the rest, it depends on whether your business is a corporation, the court where the complaint was filed (Small Claims, or Justice Court, or County Civil Court). If it's anything but Small Claims, you really should speak with a lawyer after you send in your written answer.
