I am getting sued in small claims court, and I need someone to write an offer letter for me before the court date to try and resolve the issue. This is a business broker suing me for breach of contract in the amount of $10,000.00, plus $4,000.00 for attorneys fees. I would like to offer a settlement of $5,000.00 in the form of monthly payments.

A settlement offer should be short and to the point.
It should have a caption at the top that says FOR SETTLEMENT PURPOSES ONLY.
Try this:
Dear Mr. Jones,
I would like to settle our pending lawsuit as follows: I would pay you $5000.00 at the rate of $200.00 per month with no interest; the first payment would be made on November 1, 2010, and monthly thereafter. At the conclusion of the payments you would sign a letter saying that I have paid the debt in full, and your letter would identify the debt. This offer is open until October 20, 2010, after which time it is withdrawn.
