Before I can answer that, we need to discuss how litigation works. Generally, there are issues of how a law is to be interpreted (by the judge), and issues of facts (to be determined by a jury). A summary judgment is available to a litigant in an active court case when there are no material issues of fact to be determined. If there are only issues of law to be interpreted then a judge can decide the issues in a summary judgment. The summary judgment is granted when there are no fact issues to be presented to a jury and the judge decides the issues of law.
