summary judgements

I have had a summary judgement issued against me because my attorney had not filed paperwork on time. I attemped to file an appeal, but that got dismissed because I am not a lawyer and I did not know what I was doing. Now, I have attempted to make an offer and the opposing side has made offers, but we cannot agree on a settlement. Can the courts help with payment plans? Also, since I own a small business, what is at risk that he can take? I own no property (I have a mortgage), no cars, etc. Nothing but my working capital to run the business.

The courts are not there to help with payment plans. They are there to sign judgments and execution thereof. I suppose you could ask for mediation and the court could appoint a mediator. Yes, your business is at risk.

I know you don't want to hear this, but you need to get a new attorney ASAP. There may be remedies you can pursue to save your case, assuming that they very short deadlines haven't run. In lieu of that, an attorney can help you draft appropriate settlement paperwork to work out a payment plan.
