Legal Question in Business Law in Texas
Taking vacation during 2 week notice when leaving job
I gave 2 weeks notice to my company & discovered that I had 7 days of accrued vacation that I have earned. The company has a use it or lose it policy. They will not pay me for my earned vacation time. So I have informed them that I will take my vacation time during the 2 week notice period - which they will not agree to. They want me to voluntarily give up my accrued vacation time & put in the 2 weeks notice. I am refusing to do so & have decided to take my vacation - without their approval. Can they terminate me during this time for taking vacation time that I have earned?

Re: Taking vacation during 2 week notice when leaving job
The employer has a right to control the workplace, e.g. deciding when vacation can be taken. You do not have a right to employment benefits.
