Legal Question in Business Law in Texas
Trade secret law
I started a business,hired someone with a specialized skill.He quit his last job because he felt like he was going no where.He and another man built that business together but the other man owned it.When my business partner quit he took none of the customers they aquired together.We have been in business for one year now and a few of those customers have come to us,whether it be by word of mouth or sales calls.We have lower prices and provide the equal or better quality of work.Today my partner recieved a letter stating that he was in violation of ''Texas Trade secret laws'' and ''The Lanham Laws''.The customers they had together are in the phone book and listed in ''The Blue Book'',a registration list of construction and contracting companies.My question is,are we in violation of any laws?Wouldn't that be like Wal-Mart putting K-Mart out of business by having lower prices and K-Mart suing Wal-Mart for putting them out of business?Also the gentleman threatening to sue us has been telling some of our customers that we haven't any insurance when we are fully covered.
What sre my rights?

Get in touch with a business litigator that's familiar with trade secrets and trade libel. Don't look for the cheapest; look for the best, because those letters are as serious as a heart-attack.
