Legal Question in Business Law in Texas
I wanted to start a business selling people's items on ebay for a percent of the sale's price. How do protect myself to make sure the item actually belongs to the person I'm selling it for.

Any attorney will tell you, about the only way is to have the sellers sign a statement that the item is theirs. You can also have them indemnify you and possibly add an attorneys fee clause in there as well. Also, look into insurance coverage for these types of transactions. Consult with an attorney in your area for specific advice and wording.
