Legal Question in Business Law in Texas

I work for a fortune 500 company that is setting up new standards for sales performance. If a sales person fails to be above the corporate "average" more than two months out of a six month period, they can be terminated. Is it legal to fire someone for not being above a undetermined average, or would their goal have to be a pre-determined set number? Thanks

As a Franchise Attorney I can say this. In the absence of a written employment contract, or a union, employment is "at will," meaning either party can terminate for any reason. If you don't abide by your employers policy, they can terminate for that reason, or for no reason, in an "at will" employment relationship.
