What process do I take, and how do I take it, to go to court for custody of my 3 year old son.

Hello there,

First, you should hire an attorney that is fell versed in family law. And he will file what is known as a SAPCR this is a Suit Affecting the Parent and Child relationship.

Once that is filed you will go to court and present reasons why one parent is a danger or cannot take care on the child properly.

To answer this question, we must first consider "why" you want custody and the circumstances surrounding the "need" to take custody. If there is a need or cause to take custody,particularly involving health, safety and welfare of the child, there is more than one court or jurisdiction to consider or refer you to. These are the factors the court will consider in taking such action.
