Legal Question in Civil Rights Law in Texas

civil law suit for agg assault

My daughter was stabbed in July 2007 by a ''friend''. Jury trial was set for March 9, 2009; however pre-trial hearing was yesterday, which we attended. Defendent plead guilty (5 yr prob/ 240 hrs CommServ/ parenting & drug classes and medical bills restitution in amt of 4003.75). Restitution is for medical bills incurred from the stabbing. My daughter has been seeing a psychiatrist and on meds because of this and will continue to do so for severe anxiety and depression. Can she now sue for pain and suffering and emotional and mental distress in a civil suit? If so, are their lawyers who will work on a percentage basis or will my daughter have to pay up front? Is this even worth persuing? Thanks in advance for your advice.

Re: civil law suit for agg assault

The short answer would be yes; however, my question to you would be, does the person that stabbed your daughter have any money to pay a civil judgment?
