Civil Rights violation
I was arrested on April 12, 2006 after an altercation with my now ex-wife, when she tried to stab me in the stomach after I told her that I was filing for divorce and selling my house. She ended up cutting me on my left hand, after which time I pushed her backwards and automatically swung at her and while trying to get out of the house ended up being kicked by her in my stomach area, that was injured in a work accident. The sheriff's saw my blood and I was treated by EMS personnel and she was transported to the hospital. though they verified my story, I was the one taken to jail and charged with aggravated assault. I was taken to jail and the judge charged me with a 2nd degree felony and I was held in jail for 3 months and indicted by the grand jury on the felony charge. My attorney asked the DA if she had medical evidence that she had serious bodily injuries and she said yes. She never ordered the med. reports and when my attorney took her before the judge in chambers, asked her to say to him that she did. She said that she presented the grand jury with evidence. she lied and ordered the med reports that weekend. There waw no serious injury. The charges were dismissed and i want to sue for civ right violation.
