Legal Question in Civil Rights Law in Texas
Disturbing the peace
I live near a Night Club that I have had to call the police on for disturbing the peace many times. I want to know if there is any legal action I can take against the club for having to hear the bass from their establishment in my house every weekend. I am tired of having to call the authorities and my city council, I want something done, NOW! This has been going on since they opened 3 years ago!

Re:disturbing the peace reply
Hi there,
You very well may have a cause of action against the night club for interfering with your peaceful enjoyment of your property.
The problem you may encounter is a legal term called LACHES. This means that you have allowed it to go on to long and you have therefore waived your right to bring a claim now.
You should still file suit and see what happens.
You may be able to enjoin them from playing there music at a certain decibel level.
Sincerely,
