Legal Question in Civil Rights Law in Texas
False theft accusation on background check.
My husband had a background check pulled & was turned down for a job because a past job posted theft even though he was never fined or taken to court after being accused. The law was never involved. He voluntarily paid restitution even though he was not in the wrong to save face & keep his job. He stayed w/ the company for 8 months after that until he found a better job. He was not even fired over this accusation. Now, 4 yrs. later, we have found this on his record & this is keeping him from getting any future jobs. This implied theft is a defamation of character. What is the best way to get this off his G.I.S. background check? This accusation on the background check shows there is no theft on his record but makes the companies second guess hiring him. This just isn't right for someone to be able to do this legally. Please help! Thanks,
Courtney

Re: False theft accusation on background check.
Hello there,
You need to hire an attorney to go pull his file and compare his fingerprint to the one in the file. If it is different you need to take measures to have his record expunged.
Sincerely,
