Legal Question in Civil Rights Law in Texas
My girlfriend and I were pulled over for allegedly failing to come to a complete stop at the designated point. The officer was in an un-marked vehicle, and not in uniform. He rushed to our vehicle yelling "get out of the vehicle" and only identified himself after numerous requests. He was NOT given consent to search the vehicle, in fact he was told 3 times by both myself and my girlfriend that he did not have said consent. He then arrested me for the minor traffic violation, detained my girlfriend, and had the vehicle towed and impounded. He searched the vehicle, and in the process destroyed the interioir of the vehicle and all that was in it. Then he had the third-party tow service tow it to their yard, back to the police station to search it again, and then back to the tow yard. Total tow fees- $617.00. I had to pay a $210.00 fine to get out of jail, after being formally arraigned, on a minor traffic offense. The searchs came up clean, and now we can't afford to get the vehicle out of impound. We were in the process of moving, and now my girlfriends property, including her CNA and Drivers License, are beinf held prisoner in the impound yard. Please help us! Thank you for your time. W.
