Legal Question in Civil Rights Law in Texas

My 15 year old niece is being harrassed by her ex 17 yr old boyfriend (not sexually). They were sexually active. however since then she asks him to leave her alone. Her dad works for the high school that they attend and since he knows her father can not touch him he has picked fights with the father as well as my niece. What is she to do?

report him to the police or district attorney for statutory rape...IF they were sexually active...
