Legal Question in Civil Rights Law in Texas
Is that illegal for the hotel to take pictures of empty beer cans in a room and show it to resident's employer?
1 Answer from Attorneys
What is the law? Sounds like a civil invasion of property if the "resident' was still residing there. If the "resident" was no longer staying there and left the beer cans there, then the "resident" abandoned them and had no claim to them. The employer can ask whatever he wants of the hotel and they can comply with a request or not - but again, I think it is an invasion of privacy if the "resident" is still residing there. (Although an argument could be made that the resident knew the trash would be carried out and so if they cleaning people waited until the took it outside the door then it would be okay thus there is no real harm.) Lots more info is needed.
