Legal Question in Civil Rights Law in Texas

Invasion of provacy: minor students

I have a 16 year old child who's friend lost a notebook of personal information between friends. The notebook was lost at school a month ago. Now I get a phone call from a school official who stated that I would be interested in reading this because it refers to sex, drugs, and alcohol.

This school assistant principal has made copies and distributed this information to other parents and possibly other unknown persons. Other parents are very punitive with their children regarding this issue. I feel an invasion of privacy and defemation of character issues are a potential consequence. Kids embellish on facts. I did this also in 1976. The notebook was found in the cafeteria. I have a 16 year-old honor student who is devistated by the publicity of her most intimate thoughts. What are my options, if any? Thank you for your response. Sincerely, Suzan

Re: Invasion of provacy: minor students

This was clearly an invasion of your daughter's privacy. The school officials had no right whatsoever to read the contents of the diary, much less copy and distribute it. You have a number of causes of action against the school district, and the individual officials. i.e. invasion of privacy, intentional infliction of emotional distress, violation of common law copyright, to name a few.
