Legal Question in Civil Rights Law in Texas
loan shark taking us to civil court
He's a crafty old crook, and we are a small business trying to hold on in these hard times. No excuse for being foolish but he is holding 123,000 in checks from us that we were forced into writing by his threats. We don't owe him anything. He charged over 100 percent interest monthly on every loan we took, they were numerous. He would hold the amount of the plus 100 % interest. We would get our check back when we paid the interest and write another,this went on until we paid him back--of course he never cared when. He has been paid back 100 times over.
The checks we were forced to write him---he wouldn't leave our place of business without them. He held them over a year becasue he wanted cash as to prevent being taxed on his interest. We just said no more. Much more transpired, he threatened and harrassed but finally he even turned the checks over to the DA's office but he dismissed them. Now he has taken us to civil court. We don't know what to do.We don't even have a lawyer. What rights do we have here and what kind of lawyer should we get. The ones we call don't want to handle a civil case. The ones that do want us to set up payments. No way. We do not owe him anything. What can we do?

Could it be that he has succeeded because you want to save money and not hire a lawyer? If you had paid a lawyer anything, you would have had protection. Now you want to know how to handle it yourself after you succumbed..well..go to Court and tell the judge..good luck..But if I were you..and as a lawyer..I would hire a local lawyer.
