Legal Question in Civil Rights Law in Texas

I have a neighbor who has a dead tree in their backyard. I wouldn't have a problem with it but the tree is near their fence in and his leaning toward my side of the property. We know the tree is dead because the top of the tree already fell and is being held by a large limb of the tree. I have pictures of the tree that is completely white with no leaves. I know I have to write a certified letter to the owner of the property but don't know to say. I do have an above pool and other property near the dead tree.

Tell the owner you fear that the tree will fall and hurt your children or someone on your property, and certainly will damage the fence. You can ask that he remove the tree before greater damage is caused. You do have the right to have any limbs that are over your property cut off but this is at your expense. Include copies of your photos in your certified letter.
