Legal Question in Civil Rights Law in Texas
Question - PLEASE Help this is urgent
Hello,
Yesterday evening when I got home my 4 and 9 year old were out in the front yard and one of our neighbors had her dog in our yard. I have to big dogs that were in the back yard and they heard the neighbor in the front yard with the kids and busted through the fence and attacked her dog, thinking they were protecting the girls. Now we (me and my husband) called the police to have it on file in case she called to The officers that came out explainded to us and her that because she was on our property with her dog and he dog not on a leash and that we attempted to have our dogs properly restrained that it was 60% her fault for her dog being in our yard and in our yard with out a leash and 40% our fault because they did in fact get out into the front where they were not properly restrained, but that had she not had her dog in our yard they would not have busted down the fence to protect the children. So we are under the impression that we were not at fault, now she is telling us we have to pay the vet bill when the police officer said that we were not liable. she is threatening to take us to court if we dont pay. I need to know if we should pay half or let her take us to court since she was in the wrong not is.

Police officers opinion of liability is only an opinion BUT she will not sue ...and bear costs of suit..and if she does, you will probably win..or turn over to your homeowner's insurance..and let her spend time arguing with the insurer..and it does not increase premiums
