Legal Question in Civil Rights Law in Texas

Can school principal be held liable for slander???

My son is a senior in high school. The principal has been quoted by several students and parents saying that my son is a bad kid, a pot head and even called my son's girlfriend's parents to tell them that she shouldn't date him,!! He has never been busted for drugs and the worst thing that he's been in trouble for is writing a paper titled ''administrative B.S.'' He was suspended for 3 days !

There was no profanity in the paper just the letters BS in the title. His father went to the principal and was rude so the day he came back to school they found a piece of paper that said'' Lakeview Sucks'' w/2 initials the same as my son's name so the principal suspended him again for 2 days.

They also won't count the suspension days as excused and are trying to stop him from graduating over missed days if he doesn't pay to go to Saturday classes to make up work.

What can I do?''

Neither you or your son needs to stand for this kind of behavior. Contact your local American Civil Liberties (ACLU) office. I'm sure they will assist you in this matter.

Administrative Appeal

Contact your school district and ask them to explain to you how to appeal the suspensions and graduation restrictions through the administrative appeals process. Be prepared to state your case to the school superintendent and school board. Many parents do not take advantage of the administrative appeals process because they are unfamiliar with the technical procedures. The school boards have their outside counsel to advise them. You should retain a local attorney who is familiar with "School Law." The State Bar of Texas has a School Law section with members on both sides of the fence. Look them up at MyTexasbar.com
