Legal Question in Civil Rights Law in Texas

My son was denied his right to a Court Appointed Attorney

My son was arrested for illegal possession of a weapon and possession of an illegal weapon. There was a hearing, he pled Not Guilty. They told him to get a lawyer and he told them he could not afford one and that he wanted a court appointed lawyer and the judge told him he couldn't have one that he would have to hire an attorney. Doesn't he have a right to a court appointed attorney? And if not, what is he suppose to do?

Re: My son was denied his right to a Court Appointed Attorney

No. Nobody has a guaranteed right to a court-appointed attorney. Everyone has a right to an attorney, but nobody has a guaranteed right to have the taxpayers pay for it. Your e-mail does not provide enough detail, but from what occurred, I would guess that your son did not meet the necessary local qualifications for a court-appointment. Thus, your son should hire an attorney asap, or he'll be in a tough spot. He has the right have an attorney, but he just didn't meet the necessary requirements to have law-abiding citizens pay for it.
