Taping of phone conversations without consent
I just found out in March 2004 that my ex husband is recording all phone conversations between us. He lives in Texas and I live in Tennessee with our son. I have primary residency of our son. I understand the state laws of single consent, but of course am baffled, since I have been not informed of these recordings. Is there any law that I could reference, that would aide me in the stop of the recordings? Can I state that I do not wish to be recorded in the begining of the conversations and he would not be able to record me or advise that he would continue? Would this help under the federal laws? It is very hard to try to have any conversation with him concerning our child, when you know that everything you are saying could be used against you in a court battle. I have resorted at this time, to have all interation with him through email or postal at this time because of this. If anyone can advise me if there is a way to stop this, I sure would appreciate it. Speak with a family attorney as well. Ask you attorney how you should handle this (ie should you send him an email to cease recording).
