cheating me without sending my salary
Hello sir,
I mailing this letter from india. I am having few doubts about cyber laws and its formalities. For that I need your consultation.
I havebeen working for four months with paidmail.com
(advertising agency) website in india through email, which
is situated at san antanio, txs, in america.
First I would like to give the details of my job functions and remuneration. My nature of job is introducing customers to my concern.
Till now I have joined 120 custemers directly, 22840 joined by my down line members which I introduced them. But they didnot pay my salary 4200us $(for four months).In which kind of sections, the case to be filed by through YOU for this kind of corruptions.Now I am in a difficult financial problem.Because nearly I have spend 2400 us$ for giving
ads.in magazines for to get a customers.
past
Moer over I also resigned my career(four months back)
for to concentrate this business fully.Because of that I
have lost nearly 2200us$.And also my down line members (INTD. BY ME)demanding me to compensate their losses.They are also not paid.

Several provisions of the Indian Penal Code and the Information Technology Act may apply to your case.
However, a lot depends upon the evidence that supports your claim. Only after examination of the evidence supporting your claim can I give you a proper opinion.

Before advising you on the issue, I need to know the following dertails ; have u entered into any sort of written contact with paidmail.com and also do you have any sort of contract with your downline members. If there is any we need to know the same before we can formulate a cogent opinion on the subject-matter. Firstly, you have to serve a legal notice the party, intimating the claim accured owing to the due salary and interest/damages. There should be a stipulated date, mentioned in the notice, within which such payment would have to be made, intimating further that in case the dues are not paid within the stipulated time, you have to initiate appropriate proceedings as suggested below. If the payment is made within the stipulated date, the problem ends there.
Otherwise, in case of failure of such payment, you may file a suit for recovery and damages. You may also initiate criminal proceedings against the party for cheating and criminal breach of trust. Both the civil suit and the criminal proceeding can go simultaneously.
