Use of Images on Internet w/o permission

Say myself and a buddy had a scanned sheet/image on a PC and someone takes that image and starts to use it on their Web Page, and refers to it several times. There is no credit given as to the original owners, yet the image remains un-edited with our name on the image. The person using that image never asked for permission for it's use, and after several requests to remove it, he instead, renames the file and removes the link from his web page. Yet still refers other people to that file.

Has he broken any laws by using it without asking permission? Can I ask for it's removal, and cite text from a law book to assist in his understanding of theft??

If your image that was taken by the accused webmaster was copyrighted and owned by you and your buddy, then you and your buddy have a potential claim for copyright infringement. I suggest you contact a copyright lawyer to assert your position. You shouldn't seriously expect to be given cites to the relevant statutes for free by a lawyer so you can write a cease and desist letter.
