Legal Question in Constitutional Law in Texas
probation violation
i was given a ua by my prob officer , and had a prescription for an antihistamine, which contains ingredients that show up as amphetamines. I gave the prescription info to my probation officer, and he is saying i need to take a drug class. My orig charge is for DWI (alcohol), and i have never had a drug charge or problem in my past. About two days ago the prob. officer told my step-father that I had failed a test and showed up positive for methamphetamines... I only have about a month left on prob. after a 5 yr. sentence. I was told that this was illegal for the prob. officer to discuss anyones cases with anyone at all. I don't have room here to tell you about this PO, or the other ones in this small county, but I wan't someone held accountable for this or it's going to get worse with others. Please let me know what I can do. Oh, and I was also incarcerated for almost 2 months for ''not taking a class'' that I had a certificate for at home, but the PO didn't show that to the DA. The day I went to court the DA dropped the revocation and I was set free by the judge. In short, I'm about ready to file a suit against this county. Thank you in advance.

Re: probation violation
Pick battles you can win. Try to go to your PO's supervisor or their supervisor. If that doesn't work, then you can consult with an attorney. But the main thing is that you get off of probation so you can move on with your life.
