Rights of Attorney-in-fact
Does someone acting as Attorney-in-fact have attorney client priviledge? Must this person be required to appear in a deposition regarding the case?

Re: Rights of Attorney-in-fact
An attorney-in-fact is an agent. There is no right of confidentiality such as an attorney-at-law has. Anyone may be required to provide a deposition if subpoenaed. A witness remains a witness whether or not s/he is an agent under a power of attorney - an attorney-in-fact.
