Legal Question in Constitutional Law in Texas
Unnecessary Search of Property
I had six cops barge into my house with a warrant to search for majauna. They spent the better part of an hour going through all my belonging and scattering them all about, only to find nothing. Evidently a neighbor called and claimed they had seen us using majauana, this is how they obtained the warrant. I just need to know if they way in which they obtained it is legal. It doesn't seem right to me..

Re: Unnecessary Search of Property
This is a highly technical area which requires a detailed analysis of the warrant and particularly the Affidavit which forms the basis for the warrant. Simply put, law enforcement must have a reasonable basis for accepting the word of an informant concerning drugs. Contact an experienced criminal defense attorney in your town and ask for an evaluation of your situation and an explanation of your rights. Initial consultations/case evaluations are usually done at no cost - ask first. If you don't know any attorneys, the TX Bar Association will provide recommendations.
