Legal Question in Construction Law in Texas
Civil/Construction Law
I am currently the owner of a small sole proprietorship construction company and suing a company for nonpayment totaling approx $15,000. This case has been going on since 2006 and could not be settled through mediation so I am currently awaiting a court date. I have already paid my attorney more than what I am suing for and it seems that I get a $3000-$5000 bill every 3 months and my lawyers have deposed 3 persons and met with mediator x 1. What are my rights as far as payments to my lawyer. Haven't I given them enough $$$ to work the case off of at this point. I know in criminal law you pay so much up front and are not expected to pay until the outcome of the case is settled. Do we have the same right in civil law?

Re: Civil/Construction Law
You can always talk with your lawyer about your concerns, get a new lawyer and talk with the state bar association if you are unsatisfied. You appear to be paying by the hour; so get a more detailed accounting of what they're doing for you during that time. Construction cases can be expensive and you may have a claim for reimbursement for your costs. The refund of money is because the money you pay probably goes into a client escrow account and the attorney doesn't get to keep money they don't earn.
