Legal Question in Construction Law in Texas
Is there criminal action involved when a contractor changes his subs invoices because he is deceiving the bank and the property owners to the true cost of the project. This happened several times. We began to receive lien notices. The liens are now 378k. Which is about 300k in excess of the agreed amount of the project.

Dear Inquirer: The short answer is: "YES!!!". Any intentional falsification and representations to a federally sponsored lending institution, such as a bank, may be violations of the False Claims Act - a criminal act punishable under Federal laws, and state laws as well.
Contact your County Prosecutor with the facts and documents, let the Prosecutor determine to being charges, etc.
