defective concrete foundation and framing

TRCC evaluated my custom home as being defective in framing and foundation. The house was closed in February of 2004. The builders risk policy on the house was purchased by the builder in our name without telling us. We never received a policy or was contacted by the insurance. Can we legally make the insurance polciy pay our mortgage off and reimburse the cost of demolition and rebuilding of our house? The rafters are all coming apart in the attic and the house is folding up in the middle. It is uninhabitable. The snakes nesting in the huge open cracks in the bricks aren't helping.

Builders risk insurance covers the property during construction; i.e. fire or other casualty. You are going to have to sue the builder and possibly others that may be responsible for the defective work. I'm assuming there's no extended warranty that came with the house.
