Legal Question in Construction Law in Texas
Firing a Contractor for not performing
I hired a Contractor to erect a 30'x50' Metal Bldg. At the start of the project he arrived with no tools, so I had to help him and his crew of 4 erect 3 columns with my front-end loader. After several days of explaining to the contractor how the bldg. is to be erected. I find that these guys really dont know what's going on. To make a long story short, The contractor installed one side of the roof panels and managed to miss the z purlins and left holes thru-out the metal roof (16 panels) also the several wall panels were installed incorrectly as well as other components of the building. I have asked him to read the dwgs and specs. and to use a chaulk line when he installs the roof and wall panels. still the problem continues. I have also asked him to replace the panels that have holes in them. How can I leaglly get rid of the guy before he ruins my building. By the way this gut is very arrogant!
Thanks from Texas

Re: Firing a Contractor for not performing
You hired him, you can fire him. I'd suggest that you do it in writing, stating that he's off the job because of the damage he's caused in the erection of your building. You will need to find another contractor that will repair the damage and complete the work. You will probably end up in litigation over damages, cost to complete, and what your original contractor claims you owe him.
Document everything! You'll need it.
