Legal Question in Construction Law in Texas
Inground pool installation
We had an inground fiberglass pool installed Aug 2001. This pool was supposed to be flush with the backyard, as all inground pools I have ever seen are. Our pool ended up 18 - 20 inches higher than our yard. (We now have a large hill leading up to the pool.) The pool and concrete deck around it are actually higher than the slab of our home. While standing on the decking you can see the entire neighborhood, and the neighborhood can see us, even though we have a 6-ft wooden privacy fence. This project cost $ 25,000.00. I researched beforehand and hired this pool company because they'd been in business here for so long. Toward the end of the installation we were told that the pool had water underneath from rain and would settle.......after the concrete deck was poured it was obvious this wouldn't take place. After spending this much money on a home improvement project we are utterly devastated at the outcome. Do we have recourse, i.e., should this company be made to re-do the work and place the pool at the level it should be at? Or could the company be made to remove the pool and refund our money? I did document, with video, most of the installation process.
