Legal Question in Construction Law in Texas
laws on leins, employee of ours filed one against a company we worked for and go
our company did work for a company and was waiting on the last payment, which was late in coming, as there was no other work going on and employees that worked for us had been told before work started that all payment to them would be made when we recieved payment there was and employee that was owed some money, this employee in waiting decided to rob our shop, and was seen doing this, but as of now nothing has been done legally cops wont seem to do anything. But in the process he file a lein against the company we had did the work for and the company paid him taking it off the money we were owed, i dont think this was legal, he was an employee not a subcontractor so how did he file in the first place? and some of the money he was paid wasnt even for work he did on that job. Is there anything we can do about this? thanks

He was within his rights to file a lien since he was a laborer on the job. That he may have overcharged is something you can raise with the owner, since the employee only has a claim for the work he did on the owner's job and for no other work.
