loss of fair market value of house due to fire
My 6 month old, new construction, house burned on July 7, 2001. We paid $385,000 and are the first owners and occupiers. The fire was caused by faulty wiring as determined post fire by the claims agent. We are seeking a 20% loss of fair market value (approx. $77,000) as well as other damages and attorneys' fees. The loss of fair market value is by far the largest claim. What is required to prove the loss of fair market value other than the opinion of a realtor? Thank you.

The loss of fair market value can be set forth by a realtor while presenting your claim. In order for that to be accepted as evidence at trial, however, you will need to engage an expert real estate appraiser; simply a realtor usually will not do.
