Legal Question in Construction Law in Texas
Mechanics Lien
I hired a painter to paint a house I was selling. I paid him half of the money, upfront. He would not finish the job. I had to hire another painter to finish the work.
When I went to the closing on the house. I found out he had put a lien on the property. I was not aware of an lien. In order to Close I had to put the balance of the payment in escrow.
I was not aware of any lien. Can a Painter/Construction person do that with out notification to the property owner/me?
What can be done since I do not owe him the money?

Re: Mechanics Lien
In order for the lien to properly attach he had to give you written notice by certified mail within a few days of filing the lien.
Speak with an attorney. You probably have a good case for cloud on title.
