non-paying contractor

what can i do to get the contractor to pay for the houses that we have roof is the only option i have is to file a lien on the propety

You really need some help from an attorney to perfect your lien. Here is a site with some good information on Texas mechanic's liens:

The information on that site is only a starting point. If the property is homestead, you will need some additional help from the attorney.

Placing a lien on the property is probably your safest way of getting payment. You need to send notice of non-payment to the owner by certified mail, with a copy to the contractor. Timing is critical, because if you miss the deadline, the lien cannot be perfected. Then you need to timely file your lien affidavit, with a copy to the owner also by certified mail.

Find an attorney in your area that handles M&M liens ASAP.
