painter fails to finish job

We hired a painter and signed an contract. He said he would not finish the job as he is mad at me due to my not wanting him to paint a wet home or caulk when it had stopped drizzling but was still damp with more rain to follow. We have an arbritation clause(no mention as to where or who pays what). My I file in small claims court since he left me high and dry with white caulk all over the house. I can not get someone else to finish until Spring as it is too cold now. He did return most of the paint. He asked for an advance and did return that,but put oon the check that it releases him from the contract so I can not cash it. This was above what I owed as he said that he really needed to pay his mother.I also, paid him $2565 and he owes me some of that. What should I do without incuring too much cost?
