Legal Question in Construction Law in Texas

Removal of Equipment

A service company has installed voice and data cable per commercial customers request. Customer refuses to pay for cabling service. Does the cabling Co. have the right to remove the equipment ie... patach pannels, face plates, racks, and cable that was installed if the customer does not pay for service?

Re: Removal of Equipment

The best I can give you is a "possibly", depending upon the facts and the contractual arrangements. You'd also have to remove them 'peaceably' in order to avoid lawsuits for trespass or breach of peace.

It's rarely worth taking back the equipment, since that reduces your claim.
