Legal Question in Construction Law in Texas
I had a new roof put on my house approx. a year ago and paid for new flashing. The new flashing was not installed around the chimney, they never changed the old flashing. The old flashing is damaged and caused leakage that damaged the inside wall above the fire place and the wood around the chimney. The contractor would only pay for the installation of the new flashing. I had to pay for the material and labor of all damaged areas caused by the water leakage. Can I make the contractor pay for the damages caused by the flashing he never replaced?

Yes, based on the information you have given. You can sue under a contract claim and or tort.
