Legal Question in Consumer Law in Texas

36 months or 36,000 miles Warrnty

I had my completely engine rebulid. I picked up on Friday evening. Upon arriving I notice a slight miss in the engine. I was told to drive it 500 miles and the miss would work it's self out. I went out of town that following day. The miss became worth, the vehicle almost stop on me several times. I returned the truck back to the shop the following Monday. I informed them of the problem I was having. They told me they had to keep the truck to make sure that the problem was related to the installation otherwise they were not responsible for the cost of repair. After two and a half days, I received a phone call that my truck had been sent out to an auto electrical shop to confirm what they (the mechanic shop) believed to be the problem. Two and a half days later, on that Friday, I received another phone call that my truck was ready to be picked up. I was informed that owed an additional $317.00, the price the electrical shop charged them to fix my vehicle. The electrical shop confirmed that the problem was not installation related. I informed the mechanic shop that they had no authorization to contract my truck out without my permission and expect me to pay the charges. Am I liable for the electrical shop charges?

Were you told that the problem was not warranty related? Otherwise, what happened to the warranty?
