Apartment Security Deposit Refund

My understanding of Texas State law regarding the return of a security deposit is that the deposit or an itemized list of deductions must be returned with in 30 days of the lease end date. And If you don't receive a refund or explanation postmarked within the 30-day period, you may sue for three times the amount illegally held, plus attorney's fees and a $100 statutory penalty.

In my case I was sent an itemized list of a deduction but was still owed a partial refund which was not included with the itemized list. Since the security deposit was not returned within the 30 days is the landlord liable for the $100 statutory penalty, three times the amount illegally held and any attorney's fees?
