Legal Question in Consumer Law in Texas
Application Fee Returned
I went to an apartment complex and paid $50. registration fee, $300. deposit fee and $70. applicaton fee. I chose to not get the apartment about 2-3 weeks afterward. The complex gave me my $50. registration fee and my $300. deposit checks back but, claimed I took too long to tell them I didn't want the apartment and did not return my $70. application fee. They said we could get our money back in the very beginning. They did not specify on how long I had before I would not get my money back other wise I would have told them sooner about not wanting the apartment. What can I do about getting my $70. back? Also, I gave them back their application and they said they didn't need the blank application.

Re: Application Fee Returned
What do you want to do? If you hire a lawyer -it's $150-$200/hour. If you want to file a lawsuit in small claims court - the filing fee is $50-$55. The choice is yours.
Re: Application Fee Returned
You can have an attorney determine if you have a case under the Deceptive Trade Practices Act. If you do, then you might be able to get they to reimburse your attorney fees and possibly get 3x your damages, which is still only $210 from these facts.
