Legal Question in Consumer Law in Texas
Attaining Receipts
I recently had some work done on my car or so I thought. It was an independent shop who did the work, but I insisted on dealer parts. Recently one of the parts that was supposed to be fixed is failing, and it made me question all of the work, so I called the dealership where the parts were purchased from. When I talked to the dealership they told me that the parts were returned for a full refund from the independent shop. I asked to get a copy of the returned recipts and they said NO. I am thinking about taking this to small claims court. How can I get the dealer to give me a copy of the receipts?
Also, the independent shop offered to do the tear down of the vehicle to check and replace the parts if necessary, but I do not trust them and told them that I want a unbiased third party to do it. I am going forward with this and having a local dealer inspect and replace the parts if they are not the original parts shown to me on the dealer receipts. I am wondering if I am right and these parts are either the old parts or from a discount parts store should I be able to get a refund of what it costs me to replace all parts plus labour in small claims court. Cost less than $1200. Again, also how do I get the receipts from the dealer?

Re: Attaining Receipts
Sue in Small Claims. You'll need someone to testify that the parts aren't dealer parts. You have the invoices from the independent shop, and you can testify what the dealer told you about those parts. Hearsay is allowed in Small Claims.
