Depending on the specific circumstances, this type of action could be a violation of the Texas Deceptive Trade Practices Act (TDTPA). The Texas DTPA statute was created to protect consumers against deceptive practices. This statute includes provisions against advertising a product at particular price and changing the price at the facility. It is unclear whether this applies to your particular case without knowing all of the facts. I would advise consulting an attorney who can help you.
