Auto Loan - Problem with canceling Credit Life, Disability and GAP Insurance
Hello,
I purchased a new car through a dealership on 08/22/06. I thought I was co-signing on the car so my brother-in-law with bad credit could buy the car, but I ended up being the primary buyer. At the time of sale, the dealership sold us credit life, disability and GAP insurance totaling $2,441. After learning that these insurances were not required, I went back to the dealership to cancel them on 09/14/06 (within 30 days). I filled out and signed a form requesting the cancellation, which I have a copy of. The dealership said that the insurance amounts would be credited back to my loan balance within a few months. As of 01/05/07 the balance has still not been credited to my account. I have called the dealership numerous times since then but they have not been helpful. They keep telling me to call back. They have not explained why I was never credited for the insurance or what happened.
Can I sue the dealership to get the insurance canceled and to get a refund? My understanding is that since I submitted a request to cancel the insurance within 30 days I should get a full refund on it.
