Legal Question in Consumer Law in Texas

Auto Purchase

Purchase a vehicle on 11/26/04. Was told I needed a co-signer. Co-signer agreed. Told by dealer that everything was approved but he needed to get my co-signers signature. Said they maybe able to fax but the finance company would contact co-signer. Told everything was approved Went to insurance company put full coverage on vehicle. Insurance company asked for contract and they called dealer and was faxed a copy of contract without my signature or co-signers but sales manager signed. Did not hear from company until 2/25/05 that credit was not approved on me. Was told that I stole the vehicle and I must bring back. I tried to tell what happen to the dealers owner did not want to listen. I still have truck and will be going through mediation soon. What are my chances of getting my downpayment and trade in

back. Dealer is unwilling to return my downpayment or trade in. I am listed driver of vehicle on the regristration. The dealer's name is nowhere on the regristration. Also spoke with the prior bank who owned the vehicle and the person they sold the vehicle to and they stated the vehicle was purchased at auction by the delaer and paid for. The salesmanager or credit manager who sole me the vehicle is no longer there

Re: Auto Purchase

You have just been the victim of the classic and common "Yo Yo " scam. You have a claim and should contact an attorney who handles autofraud claims. I am concerned about your statement that you will be going to mediation soon. I hope you have not agreed to binding arbitration with the Better Business Bureau. If you need an attorney in the Dallas area, feel free to contact me.
